Terms of Service

Last Updated: February 2026

1. Introduction and Acceptance

1.1 These Terms of Service ("Terms") govern your access to and use of the Wister mobile application (the "App"), operated by DONATION POS L.P. (DONATION POS E.E.), a limited partnership registered under the laws of the Hellenic Republic (Greece), with registered office at El. Venizelou 218, Kallithea, 17675, Athens, Greece, GEMI registration number 178825503000, VAT number EL802572430 (hereinafter "Wister," "we," "us," or "our").

1.2 By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

1.3 Nature of the App. Wister is a private messaging application. The App is designed for private, one-to-one communication between Users who share each other's phone number and are saved in each other's device contacts. Wister is NOT a public social media platform, broadcasting service, or content marketplace. All interactions within the App — including messages, calls, stories, and gifts — occur exclusively between Users who are mutual contacts. There is no public profile, public feed, public gifting, or open discovery of users.

1.4 Wister is a technology company that sells digital content. Wister is NOT a payment institution, electronic money institution, bank, credit institution, or financial services provider as defined under Directive (EU) 2015/2366 (PSD2), Directive 2009/110/EC (EMD2), or any applicable national legislation including Greek Law 4537/2018 and Greek Law 4021/2011.

1.5 Community Recognition Program. Wister operates an optional Community Recognition Program that provides discretionary monetary recognition to eligible Participants from Wister's own operating funds. This program:

  • (a) Is NOT a payment service, money transmission service, or financial intermediation service under Directive (EU) 2015/2366 (PSD2) or Directive 2009/110/EC (EMD2);
  • (b) Does NOT constitute electronic money issuance, stored value, or currency exchange;
  • (c) Involves Wister using its own funds to recognize Participants for their community engagement and participation, as a discretionary award initiative;
  • (d) Is entirely discretionary with no guaranteed rates, automatic conversions, or user entitlements.

2. Definitions

In these Terms, the following definitions apply:

"App" means the Wister private messaging application, including all related services, features, content, and updates provided by Wister. The App operates as a closed, contact-based communication platform where Users can only interact with other Users who are saved in their device's phone contacts.

"User" means any individual who creates an account and uses the App.

"Sender" means a User who sends a Gift to another User within the App.

"Recipient" means a User who receives a Gift from another User within the App.

"Rubies" means the digital items sold and licensed by Wister to Users within the App. Rubies are digital content — they are NOT electronic money, virtual currency, a financial instrument, stored value, or any form of monetary instrument under Directive 2009/110/EC, Directive (EU) 2015/2366, or any applicable national law. Rubies represent a limited, non-transferable, revocable license to access and use digital content within the App.

"Digital Items" means Rubies, Gifts, and any other digital content made available within the App.

"Gift" means a voluntary, gratuitous transfer of a digital item (Rubies) from one User to another within a private chat in the App. Gifts can only be sent between Users who are mutual contacts (i.e., each User has the other's phone number saved in their device contacts). Gifts are made without consideration or expectation of return.

"Community Recognition Program" means an optional program through which Wister may, at its sole and absolute discretion, offer discretionary monetary recognition to eligible Participants in recognition of their community engagement and participation within the App.

"Ruby Inventory" means the total number of Rubies held by a User within the App.

3. Eligibility

3.1 You must be at least sixteen (16) years of age to create an account and use the App.

3.2 You must be at least eighteen (18) years of age to purchase Rubies or apply to the Community Recognition Program.

3.3 Each individual may create and maintain only one (1) account. Creating multiple accounts is a violation of these Terms and may result in the suspension or termination of all associated accounts.

3.4 Account verification is performed via SMS to the phone number you provide during registration. You must have access to a valid mobile phone number to create and maintain your account.

3.5 By using the App, you represent and warrant that you meet the eligibility requirements set forth in this Section and that all information you provide is accurate and truthful.

3.6 Parental and Guardian Consent. Users between the ages of sixteen (16) and eighteen (18) may only use the App with the consent of a parent or legal guardian. By allowing a minor between 16 and 18 to use the App, the parent or legal guardian agrees to these Terms on behalf of the minor and accepts responsibility for the minor's use of the App. Users under the age of eighteen (18) are NOT permitted to purchase Rubies, participate in the Community Recognition Program, or engage in any financial transactions within the App.

4. Account

4.1 Account Creation. Accounts are created using your mobile phone number, verified via SMS. You must provide accurate and complete information during registration and keep this information up to date.

4.2 Account Security. You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You agree to notify Wister immediately of any unauthorized use of your account.

4.3 Suspension and Termination. Wister reserves the right to suspend, restrict, or terminate your account at any time if we reasonably believe that you have violated these Terms, engaged in fraudulent or suspicious activity, or for any other legitimate reason, subject to the provisions of Section 15 (Termination).

5. Rubies — Purchase of Digital Content

5.1 Nature of Rubies. Rubies are digital items sold and licensed by Wister. They are NOT electronic money, virtual currency, a financial instrument, or any form of stored value under Directive 2009/110/EC or Directive (EU) 2015/2366. Rubies represent a limited, non-transferable, revocable license to access and use digital content within the App. The purchase of Rubies constitutes a final sale of digital content from Wister to the User.

5.2 Pricing. Rubies are sold in packs. The current retail price of Rubies is 100 Rubies per 1.00 EUR (inclusive of applicable VAT). This price reflects the cost of digital content and does not establish any monetary value, exchange rate, or currency equivalence. Wister reserves the right to modify the pricing of Rubies at any time, with notice provided through the App. VAT is included in the displayed price and the applicable rate depends on the buyer's country of residence, in accordance with EU VAT rules.

5.3 Payment Methods. Rubies may be purchased using Stripe (credit/debit card), Apple Pay, Google Pay, or through In-App Purchases via the Apple App Store or Google Play Store. All payments are processed by licensed third-party payment providers. Wister does not directly process or store your payment card information.

5.4 Use of Rubies. Rubies may be used within the App to send Gifts to other Users, access in-app features, and access premium content, as made available by Wister from time to time.

5.5 Purchased Rubies vs. Received Rubies. The App distinguishes between two categories of Rubies within your Ruby Inventory:

  • (a) Purchased Rubies: Rubies acquired directly by you through a purchase transaction (Section 5). Purchased Rubies may be used to send Gifts and access in-app features, but they are NOT eligible for the Community Recognition Program (Section 7).
  • (b) Received Rubies: Rubies received by you as Gifts from other Users (Section 6). Received Rubies may be used for the same purposes as Purchased Rubies. If you qualify as an eligible Participant under Section 7, Received Rubies may be considered for discretionary rewards, subject to all eligibility requirements and approval processes.

Your Ruby Inventory displays both categories separately so that you can track your Purchased Rubies and Received Rubies at all times.

5.6 No Refunds — Digital Content. The purchase of Rubies is non-refundable, except as required by applicable law. Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from a purchase of digital content within fourteen (14) days of the transaction, provided that the digital content has not been delivered. However, by completing a purchase, you expressly consent to the immediate delivery of the digital content (Rubies) and acknowledge the following:

"I agree that the digital content is delivered immediately upon purchase and I acknowledge that I thereby waive my 14-day right of withdrawal pursuant to Article 16(m) of Directive 2011/83/EU."

This consent will be obtained explicitly at the point of purchase within the App.

5.7 Revenue. Payments received for Rubies constitute revenue of Wister. These funds are NOT held on behalf of any third party, are NOT segregated or ring-fenced for any User, and are NOT custodial funds.

5.8 In-App Purchase Platform Terms. Purchases of Rubies made through the Apple App Store or Google Play Store are subject to the respective platform's terms and conditions:

  • (a) Apple App Store: In-App Purchases made through the Apple App Store are processed by Apple and are subject to Apple's Media Services Terms and Conditions (apple.com/legal). Apple acts as the merchant of record for these transactions.
  • (b) Google Play Store: In-App Purchases made through the Google Play Store are processed by Google and are subject to the Google Play Terms of Service (play.google.com/terms). Google acts as the merchant of record for these transactions.
  • (c) Refunds for Platform Purchases: For purchases made through the Apple App Store or Google Play Store, refund requests must be directed to the respective platform in accordance with their refund policies. Wister does not process refunds for transactions handled by Apple or Google.

5.9 Virtual Items Disclaimer. Rubies and all other digital items within the App have no real-world monetary value and cannot be exchanged for legal tender, real currency, or any item of value outside the App, except solely as described in the Community Recognition Program (Section 7) at Wister's sole discretion. Rubies are not redeemable, transferable (except as Gifts within the App), or exchangeable outside the App. Wister reserves the right to manage, regulate, control, modify, suspend, or eliminate Rubies and other digital items at its sole discretion, and Wister shall have no liability to you or any third party for exercising such rights.

6. Gifts — Voluntary Transfer of Digital Items

6.1 Nature of Gifts. Sending a Gift is a voluntary, gratuitous transfer of a digital item from one User to another within a private chat, with no expectation of consideration or return. Gifts can only be sent between Users who are mutual contacts — that is, each User must have the other's phone number saved in their device contacts. Gifts are NOT public; they are exchanged privately between individuals who know each other. Gifts are intended to celebrate special occasions such as birthdays, namedays, weddings, anniversaries, and other personal milestones. No money, funds, or monetary value is transmitted between Users at any point during a Gift transaction. Gifts involve only the transfer of digital items within the App.

6.2 How Gifts Work. Within a private chat between mutual contacts, the Sender selects a Gift from the catalog and sends it to the Recipient. The corresponding number of Rubies is deducted from the Sender's Ruby Inventory and added to the Recipient's Ruby Inventory. There is no public gift feed, public leaderboard, or public display of gifts.

6.3 No Payment Services. Wister does not provide payment services, money transmission services, or act as a payment intermediary between Users. No commission or fee is charged by Wister on Gift transactions between Users.

6.4 Irrevocability. Gifts are irrevocable once sent. A Sender cannot recall, reverse, or cancel a Gift after it has been transmitted to the Recipient.

6.5 Prohibited Gift Practices. The following practices are strictly prohibited and may result in account suspension or termination:

  • (a) Sending Gifts to yourself (self-gifting), whether directly or through intermediary accounts;
  • (b) Participating in send-receive loops or coordinated gifting arrangements designed to circumvent these Terms or manipulate the Community Recognition Program;
  • (c) Sending Gifts as part of any commercial transaction, payment for services, or exchange of value outside the App;
  • (d) Using Gifts or the Community Recognition Program for: money laundering or terrorist financing, tax evasion schemes, commercial transactions disguised as gifts, or any form of prohibited financial activity;
  • (e) Any other conduct that manipulates or abuses the Gift system.

7. Community Recognition Program

7.1 Nature of Program. Wister operates an optional Community Recognition Program to recognize Users for their community engagement and participation within the App. This is a discretionary recognition initiative, not a payment service, withdrawal mechanism, or currency exchange. Wister uses its own operating funds to provide discretionary monetary recognition to eligible Participants. Because the App is a private, contact-based messaging platform, Received Rubies originate exclusively from private Gift transactions between mutual contacts — not from public tipping, broadcasting, or open solicitation.

7.2 Eligibility Requirements. To be considered for the Community Recognition Program, a User must:

  • (a) Be at least eighteen (18) years of age;
  • (b) Have maintained an active account in good standing for at least ninety (90) consecutive days;
  • (c) Have accumulated a minimum of 10,000 Received Rubies (Rubies received as Gifts from other Users - Purchased Rubies are NOT eligible);
  • (d) Have created and published at least 20 Stories within the App;
  • (e) Have at least 100 active contacts within the App;
  • (f) Successfully complete identity verification (KYC) including government-issued ID, proof of address, and tax documentation;
  • (g) Agree to Wister's Participant Agreement;
  • (h) Not have violated these Terms or engaged in prohibited conduct as defined in Section 9.

7.3 How the Program Works.

  • (a) Application Process: Eligible Users may apply to the Community Recognition Program through the App. Applications are subject to manual review and approval by Wister.
  • (b) Discretionary Awards: Wister may, at its sole and absolute discretion, offer to provide monetary recognition to a Participant in recognition of their community engagement and participation. There is no automatic conversion, guaranteed rate, or entitlement to any reward.
  • (c) Evaluation Criteria: Wister considers multiple factors when determining rewards, including but not limited to: quality of community engagement and participation, positive interactions within the community, account history and compliance with Terms, and platform needs and budget availability.
  • (d) Reward Calculation: When Wister chooses to offer a reward, the calculation is based on Wister's internal discretionary formula, which may consider the number of Received Rubies, community engagement metrics, and other factors. The reward rate is NOT fixed and may vary per Participant and per transaction.

7.4 Reward Limits and Restrictions.

  • (a) Minimum Threshold: 10,000 Received Rubies
  • (b) Maximum per Transaction: 100,000 Received Rubies
  • (c) Frequency Limit: Maximum two (2) reward transactions per calendar year
  • (d) Cooling Period: Received Rubies must be held for at least sixty (60) days from receipt before they can be considered for a reward
  • (e) Annual Cap: Maximum total rewards of €5,000 per User per calendar year

7.5 Service Fee. To cover administrative processing, payment provider fees, compliance verification, and operational costs, Wister charges a service fee of twenty-two percent (22%) of the gross reward amount. The net amount payable to the Participant will be clearly displayed before acceptance.

7.6 Payment Method. Rewards are paid exclusively via bank transfer (SEPA) or PayPal, at Wister's discretion based on the Participant's location and verification status. Participants must provide valid banking details or a verified PayPal account.

7.7 Processing and Approval.

  • (a) All reward applications are subject to thorough manual review, which may take fifteen (15) to thirty (30) business days.
  • (b) Wister reserves the right to request additional documentation, including but not limited to: tax identification number, proof of content creation, source of Received Rubies verification, and additional identity verification.
  • (c) Wister may deny any reward application for any reason or no reason, including but not limited to: suspected violation of Terms, inadequate content quality, suspicious gifting patterns, incomplete documentation, or budget limitations.

7.8 Tax Reporting and Compliance.

  • (a) Participants are solely responsible for all tax obligations arising from rewards received.
  • (b) Wister will issue appropriate tax documentation as required by law.
  • (c) For Participants receiving rewards exceeding thirty (30) transactions OR two thousand euros (€2,000) in aggregate within a calendar year, Wister is required to report transaction information to relevant tax authorities under Directive 2021/514/EU (DAC7) and applicable Greek tax law.
  • (d) Wister may require Participants to complete tax forms (e.g., W-9, W-8BEN, or Greek tax declaration forms) before processing rewards.

7.9 Anti-Fraud and Compliance Measures.

  • (a) Wister employs automated and manual fraud detection systems to identify suspicious patterns, including but not limited to: self-gifting schemes, coordinated gifting loops, rapid accumulation of Rubies inconsistent with genuine use, multiple accounts operated by the same individual, velocity anomalies, shared payout accounts across multiple users, suspicious withdrawal frequency, and payment disputes and chargebacks.
  • (b) Wister maintains an automated risk scoring system that assigns a numerical risk score (0-100) to user accounts based on detected activity patterns. Accounts that exceed defined risk thresholds may be subject to: enhanced review of reward applications, temporary hold on reward processing pending investigation, and suspension of payout eligibility until the account is cleared.
  • (c) Participants found to be manipulating the system will be permanently banned from the Community Recognition Program and may have their accounts terminated.
  • (d) Wister cooperates with law enforcement and regulatory authorities and will report suspected money laundering, fraud, or illegal activity as required by law (Directive (EU) 2015/849, Greek Law 4557/2018).

7.10 No Guaranteed Rights.

  • (a) No Entitlement: Participation in the Community Recognition Program does NOT create any contractual right, entitlement, or obligation for Wister to purchase Rubies or provide rewards.
  • (b) Full Discretion: Wister retains full discretion to: accept or reject any application, modify reward rates, terms, or criteria, suspend or terminate the Program entirely, change eligibility requirements, and impose additional verification measures.
  • (c) Not a Currency Exchange: The Community Recognition Program is NOT a currency exchange service, withdrawal mechanism, or redemption of stored value. Rubies have no monetary value, are not redeemable for cash, and do not represent stored value, electronic money, or a financial instrument. Rewards are discretionary monetary recognition provided by Wister from its own funds in recognition of a Participant's community engagement and participation.

7.11 Program Modification and Termination. Wister reserves the right to modify, suspend, or permanently discontinue the Community Recognition Program at any time, with or without notice, for any reason including but not limited to regulatory changes, business decisions, or platform strategy. Wister will make reasonable efforts to provide advance notice of material changes where feasible.

8. Tax Responsibility

8.1 You are solely responsible for determining and fulfilling any tax obligations that may arise from your use of the App, including but not limited to gift tax, income tax, or any other tax applicable in your jurisdiction.

8.2 Wister does not provide tax, legal, or financial advice. You should consult a qualified tax professional regarding your individual circumstances.

8.3 Wister may be required to report certain transaction information to tax authorities under applicable regulations, including but not limited to Directive 2021/514/EU (DAC7) and Greek tax reporting obligations. Under DAC7, Wister is required to report User information to the relevant tax authorities where a User receives Community Recognition rewards exceeding thirty (30) transactions or two thousand euros (2,000 EUR) in aggregate within a calendar year.

9. Prohibited Conduct

9.1 You agree not to use the App for any of the following purposes or activities:

  • (a) Any purpose that is unlawful, fraudulent, or prohibited by these Terms;
  • (b) Sending spam, unsolicited communications, or bulk messages;
  • (c) Harassing, threatening, bullying, or abusing other Users;
  • (d) Creating fake accounts, impersonating another person, or misrepresenting your identity;
  • (e) Manipulating the Gift or Community Recognition system, including self-gifting, send-receive loops, coordinated schemes, or fraudulent reward applications;
  • (f) Using the App for money laundering, terrorist financing, or any activity that violates applicable anti-money laundering laws (Directive (EU) 2015/849, Greek Law 4557/2018);
  • (g) Uploading, sharing, or transmitting content that is illegal, harmful, defamatory, obscene, or infringes the intellectual property rights of any third party;
  • (h) Attempting to access other Users' accounts, personal data, or private communications;
  • (i) Reverse-engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the App;
  • (j) Using automated tools, bots, scrapers, or scripts to interact with the App;
  • (k) Circumventing or attempting to circumvent security measures, rate limits, access controls, or other protective mechanisms;
  • (l) Using the same payout account (PayPal or bank details) across multiple Wister accounts;
  • (m) Filing fraudulent chargebacks or payment disputes with the intent of retaining both the purchased digital content and the refunded funds.

9.2 Violation of these rules may result in immediate account suspension or termination, forfeiture of privileges, payout freeze, and, where appropriate, referral to law enforcement authorities.

9.3 Automated Detection. Wister uses automated systems to monitor transaction patterns for potential abuse. These systems may flag accounts for manual review based on activity thresholds. If your account is flagged, you may be contacted for additional verification before certain features (including Community Recognition payouts) are processed.

10. Content Guidelines

10.1 User-Generated Content. You retain ownership of the content you create within the App, including messages, stories, and profile information. By posting or transmitting content through the App, you grant Wister a limited, non-exclusive, royalty-free license to display, transmit, and process that content as necessary to operate and provide the App's services.

10.2 Stories. Stories posted within the App are visible to your contacts for twenty-four (24) hours, after which they are automatically deleted from our servers.

10.3 Encrypted Messages. Chat messages within the App are protected by End-to-End Encryption. Wister cannot read, access, or monitor the content of encrypted messages.

10.5 Push Notifications. The App may send you push notifications, including but not limited to: new messages, gift notifications, celebration reminders, and service announcements. You may disable push notifications at any time through your device settings. Disabling push notifications may affect your ability to receive timely updates about gifts and messages.

11. Intellectual Property

11.1 The App, including its design, source code, graphics, user interface, logos, and branding, is owned by Wister and is protected by applicable intellectual property laws, including copyright and trademark law.

12.3 In the course of providing the App's services, your data may be processed by third-party service providers, including Stripe, PayPal, Apple, and Google. These providers operate under their own privacy policies and terms, and you are encouraged to review them.

13. Disclaimer of Warranties

14. Limitation of Liability

14.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WISTER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO WISTER IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WISTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR INTERRUPTION OF SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

  • (c) Violations: In cases of termination due to fraud, illegal activity, or serious violation of these Terms, Wister reserves the right to suspend Community Recognition Program privileges entirely, subject to applicable law.
